General Terms and Conditions

1. Scope
These General Terms and Conditions (GTC) govern the contractual relationship between swissnautix GmbH (“the Provider”) and the users of the swissnautix platform and the associated mobile applications (“the Services”).
2. Subject matter of the contract
The Provider makes available a Software-as-a-Service platform for the management of boats, service processes and associated data. The specific scope of functions depends on the chosen subscription (Basic, Smart, Premium or Partner licence).
3. Conclusion of the contract
The contract is concluded upon registration and confirmation of the chosen subscription. For boatyards and partners, individual licence agreements apply in addition.
4. Prices & payment
The prices published at the time of ordering apply. Billing takes place – depending on your choice – monthly or yearly in advance. All prices are in Swiss francs (CHF), plus any applicable statutory value-added tax.
5. Term & termination
Subscriptions renew automatically for the respective chosen period unless they are terminated before expiry. Termination is possible via the user account or by e-mail to contact@swissnautix.ch.
6. Obligations of users
Users are responsible for the accuracy of the data they enter and undertake to keep their access credentials confidential and not to use the Services abusively.
7. Availability
The Provider endeavours to ensure a high availability of the Services but cannot guarantee uninterrupted availability. Maintenance windows are announced in advance where possible.
8. Liability
The Provider's liability is limited to intent and gross negligence, insofar as this is legally permissible. Any liability for indirect or consequential damages is excluded.
9. Applicable law & place of jurisdiction
Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Baar (canton of Zug), Switzerland, unless mandatory statutory provisions provide for another place of jurisdiction.
